Terms of service

These terms & conditions form a legally binding agreement between you (“the customer”) and Baby Swimmers LLP (“we”, “us”, “our”). By booking online or attending our classes, using our websites, or purchasing our products, you agree that you have read, understood and accepted these terms & conditions.

If you do not accept these terms, please do not use our services.
1. About Us

Baby Swimmers LLP provides swimming lessons through two brands:

• Baby Swimmers – www.babyswimmers.co.uk
• Swimmers Academy – www.swimmersacademy.co.uk

2. Class Structure and Fees

• Classes run in line with the school term in your area.
• Fees are £14.50 per class, booked and paid for in advance as a block.
• If you join part way through a term, you will pay for the full block of classes. You will attend the
remaining classes in the current term, and any classes that took place before your start date will be carried
forward to the following term so that you receive your full entitlement of classes.
• Payments are non refundable, non transferable, and cannot be carried over unless stated otherwise.

3. Payment Terms

• Payment is taken by debit or credit card over the phone or through our online portal
• Your card details are securely stored for future term payments.
• Only the last 4 digits of your card are retained for reference.
• Online shop payments are processed through a secure third party gateway.

4. Automatic Rebooking

• Your place is automatically rebooked for the next term and payment will be deducted on a specified date.
• Rebooking notifications are sent approximately 5 weeks before the new term.
• Payment is taken approximately 3 weeks before the new term.
• If the class time or day needs to change, we will contact you first.
• To cancel your place, you must notify us before the payment date.

5. Cancellations and Refunds

• Once the new term has started, fees are non-refundable except where required by law.
• If you cancel before the new term begins, you will receive a refund minus a £25 admin fee.
• Refunds or discounts are not available for missed classes due to holidays, sickness, or personal
circumstances, as our costs remain the same whether or not everyone is able to attend.
• Classes cannot be carried forward except in exceptional circumstances at our discretion.

6. Class Cancellations by Baby Swimmers

If we must cancel a class, refunds are not available, however a replacement class will be offered. Cancellation could be due to:

• Adverse weather
• Instructor sickness
• Pool contamination
• Pool closure
• Other unforeseen circumstances

If the pool closes due to an infectious disease, epidemic, pandemic, or similar event, a replacement class will be offered once the pool reopens or an alternative class may be provided.

7. Catch Up Classes

• You may request up to 2 catch up classes per term if you have been unable to attend your regular class
due to sickness or holiday.
• Catch ups are a good will gesture and will depend on availability so cannot be guaranteed.
• Requests must be made by email.
• You may only attend a catch up once you receive confirmation of the time, day, and venue.
• Catch ups must be taken within the same term and cannot be carried forward.

8. Changing Your Class

To permanently change your class day, time, or venue:

• Wait for written confirmation before attending the new class

9. Health, Safety & Responsibilities

• You must ensure that all information provided (including medical details) is accurate and kept up to date.
• You are responsible for supervising your child at all times during classes.
• You must follow pool rules and instructor guidance.
• We reserve the right to remove any participant whose behaviour is unsafe or disruptive.

10. Photography

• We occasionally run photo shoots with approved third party photographers.
• If you attend a photo shoot, you will complete a separate registration form.
• The photographer is responsible for their own privacy and data practices.

11. Intellectual Property

All website content, class materials, and branding are protected by copyright. You may not copy, reproduce, broadcast, or distribute any content without permission.

12. External Links

Our websites may contain links to external sites. We are not responsible for the content, privacy practices, or security of external websites.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will be posted on our websites and emailed to current customers. Continued use of our services indicates acceptance of the updated terms.

• Payment details (processed securely through a specialist third party secure payment gateway with
only last 4 digits retained)
• Emails, enquiries, feedback
• Website usage data (cookies, IP address, device info)

• Attend classes or photo shoots

We do not purchase marketing lists.

The privacy of the contact details that you provide to us will be respected at all times. The email address that you provided to us will not be disclosed to any third parties and we will never sell your data.

6. Children’s Data

All child information must be provided by a parent or guardian. The special category data we hold regarding health issues is only shared with your teacher to ensure the health and safety of yourself or child should you need medical assistance.

8. Sharing Your Data

We do not share data for third party marketing. We will only share your information where we are legally obliged to do so or where an emergency situation arises. We use a third party for our photo shoots who will have their own privacy policy. If you attend a photo shoot you will be asked to complete a separate registration form which will be sent directly to the photographer for the purposes of the photo shoot only. We do not accept any liability or responsibility in terms of the privacy and security practices of any third party and suggest you visit their website for information on their privacy statement.

9. International Transfers

Some of our service providers may process or access personal data outside the United Kingdom, including within the European Economic Area (EEA).
Where personal data is transferred outside the UK, we ensure appropriate safeguards are in place in accordance with UK GDPR. These safeguards may include:

10. Data Retention

Your information is securely stored at the Baby Swimmers office and through our online administration system.
Your information will be held as long as we provide a service to you whilst you attend our classes. If you prefer not to be contacted in the future, please email us at info@babyswimmers.co.uk and we will remove your details from our database.

• Paper records: 1 year after your last class or contact with us
• Electronic records: 5 years
• Financial records: 7 years

Data is securely deleted after these periods.

Reasonable measures are taken to protect personal information from access by unauthorised persons, however we cannot guarantee the security of your personal data submitted by email or through our website, therefore any transmission is at your own risk.

11. Your Rights

You have the right to:

• Access your data
• Correct inaccurate information
• Request deletion
• Restrict processing
