Terms of service

The following terms and conditions act as the agreement between the customer ("you") and Baby Swimmers ("us"). Please read these terms and conditions carefully. By using our online services you agree that you have read, understood and accepted these terms and conditions. If you do not wish to be bound by them then please DO NOT join Us as a member and leave this website immediately!

These terms and conditions become legally binding when you use our online services.
Baby Swimmers runs classes in line with the school term in your area. Classes are £12.50 per class for babies and toddlers which are booked in advance and paid for as a block. If you join part way through a term, you will still pay for the full block and take any remaining classes of the block in the new term. If you are unable to attend for any reason, your payment is non refundable, non transferable and cannot be carried over to a new term. If a space becomes available, you may be offered an alternative class, however this isn't guaranteed.

Your place will be automatically rebooked for the new term and payment taken on a specified date, unless an email or phone call is received within the required time to confirm you no longer require a place. The rebooking notifications are sent approximately 5 weeks before the new term starts and payment will be deducted approximately 3 weeks before the new term starts. If the time or day of your class needs to be changed you will be contacted first to ensure you are happy with this.

Please note that payments for classes are non refundable once the new term has started. If you cancel before the new term begins you will receive a refund less £20 admin fee. Also discounts or refunds will not be available if you are unable to attend classes due to holidays or sickness, as our costs remain the same whether or not everyone is able to attend. Classes cannot be carried forward to the new term, except in exceptional circumstances.

In the instance of the pool having to close due to an infectious disease, epidemic or pandemic or for any other reason, a refund will not be available. A replacement class will be offered once the pool reopens or you can attend an alternative class.

Payment is over the phone by debit or credit card which will be kept on record and used for each new term.
If a class is cancelled due to adverse weather conditions, sickness or soiling in the pool, or due to other unforeseen circumstances a replacement class will be offered to you. Please note a refund will not be available.

A maximum of 2 Catch up classes may be offered per term if you are unable to attend your class for whatever reason. This will depend on availability so cannot be guaranteed. Any catch ups must be requested by email and can only be attended if confirmation is received of the time, day and venue of the class. Catch ups must be taken in the present term and cannot be carried forward.

If you need to change the day, time or venue you attend swimming on a permanent basis, you must email info@babyswimmers.co.uk to request this and be in receipt of a confirmation email before the new class can be attended.

Baby Swimmers reserves the right to vary the terms and conditions of this agreement at any time. Any such changes will be posted online and sent to all current members by email. By the use of the website after such changes are implemented you are deemed to have accepted the changes to the terms and conditions as if they were the original terms and conditions. Please review these terms and conditions at regular intervals to ensure you are aware of any changes made to them.

The privacy of the contact details that you provide to us will be respected at all times. The email address that you provide to us will NOT be disclosed to any third parties.

The contents of the Baby Swimmers web pages are subject to copyright. You may not copy, reproduce, display, broadcast, transmit, make available for retrieval or otherwise use the content in any way except for your own personal use.

Baby Swimmers cannot assume responsibility for any external website or other document to which a link is provided.

Privacy policy

Baby Swimmers LLP is committed to protecting your privacy and because we gather information from you, this privacy policy sets out the information we collect and relates to any and all personal data that you provide to us and how we use it. By completing our online form, registering your interest or placing an order, either through our website, by email or phone you consent to the collection, use and transfer of your information under the terms of this policy, which is for the sole use of Baby Swimmers LLP.

What type of information we have
We currently collect and process the following information:

We ask for information which will include your name as parent, or carer and the name of the child you are bringing to our classes, together with their date of birth and any medical details we should be aware of. The details we collect include your home address, email address, contact number and an emergency contact name and number. This is to ensure we can fully provide the service or goods you have requested. All the details you provide are for the sole use of Baby Swimmers and are not transferred to a third party.

How we get the information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:
We provide our service of swimming classes and may need to contact you by email, phone or text if we have to query any details with you or to advise you of any important changes to your swimming class, a cancellation or rebooking for subsequent terms. We may also ask you for feedback on classes and services. If you attend our classes, we will also contact you to let you know about other products, special offers and services we offer and will let you know when our next photo shoots are taking place and any special offers associated with these too.

We provide an online shop and also take orders over the phone for our products and services. The information we collect will include your name, address and credit or debit card information in order to process your order and send it out to you. Your payment details are input into a specialist third party secure payment gateway. The only details retained by Baby Swimmers are the last 4 digits of your card for reference purposes and to ensure future recurring payments are processed correctly. When payments are made through our online shop this is exclusively through the specialist secure online portal, which Baby Swimmers does not have access to. We do not sell or share this information to others in any way.

What we do with the information we have

We use the information that you have given us in order to contact you with any important updates to your class, rebooking for subsequent terms or for your feedback on classes and services. Your teacher will have your name, child's name, date of birth and any medical details. The special category data we hold regarding health issues is only passed to the teacher of your class to ensure the health and safety of yourself or child should you need medical assistance. We will only share your information where we are legally obliged to do so or where an emergency situation arises. We use a third party for our photo shoots who will have their own privacy policy. If you attend a photo shoot you will be asked to complete a separate registration form which will be sent directly to the photographer for the purposes of the photo shoot only. We do not accept any liability or responsibility in terms of the privacy and security practices of any third party and suggest you visit their website for information on their privacy statement.

How we store your information

Your information is securely stored at the Baby Swimmers office and through our online administration system.
Your information will be held as long as we provide a service to you whilst you attend our classes. We will hold paper files for 1 year following your last class or contact with us, after which they will be disposed of securely. Any online details will be deactivated on finishing your classes with us, however they will remain on our database for 5 years following your last class with us, after which time they will be deleted. If you prefer not to be contacted in the future, please email us at info@babyswimmers.co.uk and we will remove your details from our data base.

Data protection and your rights

Reasonable measures are taken to protect personal information from access by unauthorised persons, however we cannot guarantee the security of your personal data submitted by email or through our website, therefore any transmission is at your own risk.

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances.
Your right to object to processing - You have the right to object to the processing of your personal data in certain circumstances.
